O campo de batalha for a W3C (World Wide Web Consortium) que define os padrões para a "Open Web" (que agora se tornou Closed Web). De um lado, as mega corporações tradicionais e as novas (Netflix). De outro todo o resto do mundo. Pela primeira vez na história, uma decisão da W3C foi tomada sem ser por consenso e com uma margem pequena de vantagem, pela implementação do EME (Encrypted Media Extensions), que é a forma pela qual DRM deverá ser implementado em navegadores. A participação do presidente/diretor da W3C sir Tim Barnes Lee na empreitada foi essencial para a derrota da humanidade. Como resultado desse fiasco, a EFF (Eletronic Frontier Foundation) saiu da W3C. Por isso que vejo com um certo pé à trás a Web Foundation.</p>

Tais esquemas, no entanto, são ineficazes do ponto de vista tecnológico para evitar cópias (sempre será possível quebrá-los), mas são muito eficazes para um lado muito sinistro: o uso da lei para controlar criadores e evitar que usos legais e permitidos pelas leis de direito de autor sejam usadas.</p>

Você pode usar trechos de peças criativas para fazer críticas, analisar, dar aulas, etc. Além disso, plea doutrina do "first use" (primeira aquisição de um produto), a pessoa pode fazer o que quiser com um livro ou disco que comprar, inclusive doá-lo para uma biblioteca, emprestá-lo para quantos amigos você quiser ou revendê-lo no mercado de usados.</p>

<p style=" margin-top:0px; margin-bottom:0px; margin-left:0px; margin-right:0px; -qt-block-indent:0; text-indent:0px; -qt-user-state:0;">Portanto, para que a mega-corporação não receba críticas de seus produtos ou que não queira que um terceiro possa concertar um equipamento seu, ou não queira que o consumidor final tenha qualquer direito legal (que ele teria se o meio não fosse digital), basta colocar algum tipo de proteção "furada" no produto de software e processar quem tentar burla-lo pelo DMCA.</p>

<p style=" margin-top:0px; margin-bottom:0px; margin-left:0px; margin-right:0px; -qt-block-indent:0; text-indent:0px; -qt-user-state:0;">Desta forma passa a ser crime: tentar estudar um produto com DRM pra saber se há falhas, publicar resultados de descobertas de bugs, emprestar para seu amigo um produto, tentar reparar um trator que você comprou legitimamente, tentar trocar o sistema operacional ou software de algo que você tenha comprado legalmente, tentar disponibilizar acessibilidade para algum produto (para permitir que cegos possam ler um livro, por exemplo), etc. Além disso, ainda deixam o autor refém de plataformas draconianas.</p>

A única forma de você implementar DRM efetivamente é se você usar software proprietário (caixa preta) no seu dispositivo e dotá-lo de várias medidas legais, à lá DMCA, para criminalizar os usuários. Se isso virar tendência, com o tempo, a Web, que era aberta, será fechada e protegida por DRM em tudo que você vê. Além das amarras digitais, a Open Web se tornará uma Closed Web, um campo minado legal, onde qualquer tentativa de copiar e colar alguma coisa poderá levar o usuário para a cadeia, se isso for comercialmente interessante para as mega-corporações. Além disso: se as propagandas e o rastreamento forem "protegidos" (mesmo que de maneira tosca) por DRM, usar um bloqueador de propagandas (tipo AdBlock) poderia ser considerado crime.</p>
